Eligibility
Banvari’s drawing is
open only to legal residents of the
United States who are twenty one (21) years or older at the time of
entry. Void
where prohibited by law. Employees of Sponsor(s), their respective
parents,
affiliates, subsidiaries, advertising and promotional agencies and the
immediate family members of each are not eligible.

By participating in
this Drawing,
entrants fully and unconditionally agree to and accept the terms of
these
Official Rules and the decisions of Sponsor(s), which are final and
binding on

Entry
Beginning Oct 1, 2006 (12:01 a.m. EST) through Dec 24, 2006 (11:59 PM
EST),
("Drawing period"), please complete one official entry form located
on the Banvari.com site. You will be asked to provide your first and
last name,
address, telephone number, and email address. Online entrants must
complete the
entire online entry form in order to be eligible. You may also be asked
to
answer optional questions; however, they need not be answered in order
to be
eligible for the Drawing. One entry per person, per household, per
email address
is allowable.
General
This drawing is subject
to all applicable federal, state,
provincial, and local laws. Void where prohibited or restricted by law.
Participant consents to the use of his/her name, biographical
information,
photographs and/or likeness for advertising and publicity purposes
without
additional compensation, except where prohibited. Participant agrees
that the
sponsor, its affiliates, their respective agencies and employees shall
not be
liable for injury, loss or damage of any kind resulting from
participating in
this promotion or from the acceptance or use of any gifts awarded.
Conditions
All eligible entrants must enter their drawing form using the online methods described above. Incomplete entries will be considered void. By entering Banvari's drawing, participants acknowledge compliance with these official rules including all eligibility requirements. Online entrants must be the registered subscribers of the email account by which the entry is made. All entries become the property of the sponsor and will not be returned. Neither Banvari, its affiliates, subsidiaries, divisions, advertising and promotion agencies, nor any telephone network or service providers are responsible for incorrect or inaccurate transcription of entry information, or for any interruption, deletion, defect, line failures of any telephone network, or problems relating to computer equipment, software, inability to access any web site or online service, or any other error or malfunction, or illegible entries.

"Diamond
Stud Earrings"
The drawing offer consists of set of Diamond Stud Earrings (total
diamond
weight ½ carat and 14k white gold), to be given as a prize at
the end of the drawing
period.
Results
Winner
will be
selected in a random drawing to be held on or about 12/25/2006 among
all
eligible computer entries received. Winner will be notified via email
and/or
telephone. Odds of winning depend on the number of eligible entries
received.
Prize winner must execute and return an Affidavit of Eligibility, a
Prize
Acceptance Form, and a Release of Liability before the prize will be
awarded.
Return of any prize notification and/or prize as undeliverable may
result in
disqualification and selection of an alternate winner.
Shipping
After contacting the winner and obtaining his or her shipping address,
Banvari
will immediately ship the Pendant via FedEx or UPS service.
Limitations of Liability
Sponsor(s) are not
responsible for any incorrect or
inaccurate information, whether caused by website users or by any of
the
equipment or programming associated with or utilized in the Drawing or
by any
technical or human error which may occur in the processing of
submissions in
the Drawing. Sponsor(s) assume no responsibility for any error,
omission,
interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorized
access to, or
alteration of, entries. Sponsor(s) are not responsible for any problems
or
technical malfunction of any telephone network or lines, computer
on-line-systems, servers or providers, computer equipment, software,
failure of
email or players on account of technical problems or traffic congestion
on the
Internet or at any website or combination thereof, including injury or
damage
to participants or to any other person's computer related to or
resulting from
participating or downloading materials in this Drawing. If, for any
reason, the
Drawing is not capable of running as planned, including infection by
computer
virus, bugs, tampering, unauthorized intervention, fraud, technical
failures,
or any other causes beyond the control of Sponsor(s) which corrupt or
affect the
administration, security, fairness, integrity or proper conduct of this
Drawing, Sponsor(s) reserve the right at their sole discretion to
cancel,
terminate, modify or suspend the Drawing without prior notice.
Disputes
By participating in
this Drawing, entrants agree that: (1)
any and all disputes, claims, and causes of action arising out of or
connected
with this drawing or any prizes awarded shall be resolved individually,
without
resort to any form of class action, and exclusively by the Superior
Court of
California (Orange County) or the appropriate California State Court
located in
Orange County, California; (2) any and all claims, judgments and awards
shall
be limited to actual out-of-pocket costs incurred, including costs
associated
with entering this drawing but in no event attorneys’ fees; and (3)
under no
circumstances will entrant be permitted to obtain awards for and
entrant hereby
waives all rights to claim punitive, incidental and consequential
damages and
any other damages, other than for actual out-of-pocket expenses, and
any and
all rights to have damages multiplied or otherwise increased. SOME
JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
All issues
and questions concerning the construction, validity, interpretation and
enforceability of these Official Rules, or the rights and obligations
of the
entrant, Sponsor(s) in connection with the drawing, shall be governed
by, and
construed in accordance with, the laws of the State of California,
without
giving effect to any choice of law or conflict of law rules (whether of
the
State of California or any other jurisdiction), which would cause the
application of the laws of any jurisdiction other than the State of
California.
